    “The second point I want to hit on is more of a personal one. Please everyone for the love of all that is good, do not sell modded consoles with pirated games online, or like, ever. Time and time again the people who do this get sued into oblivion and it’s just super unethical. Outside of the raw piracy problem, this kind of behavior contributes to our whole community looking like nothing but pirates and directly ties homebrew lovers with piracy in the eyes of the law. It’s hard enough as it is, please don’t make it any harder for us.”

    >>> Preach on brother.

    Thoughts: Personally I want him to win. But it won’t happen. However it will be meme’d to Heck and back. Fun times.

    Keep it up!

    Well from what you provided he never denied he owns a website, in the first image he denies the whole point and it is not only about owning website.

    Let’s hope he’s playing 4D chess with nintendo and will outwit them to the best outcome possible for the community. I’m indulging myself in naivety right now, but DMCA’s anti-circumvention law is another step taken too far after ridiculously long copyright terms and should be fought against using all means possible.

  5. Axido says:

    So, do the consoles actually go back to their owners with pirated software installed? If that is the case, it would be dumb as heck. If you need to cater to pirates, don’t go for those too dumb to download the stuff themselves.

  6. PsybrPyrit says:

    I primarily mod to pirate

    Generally nintendo’s legal team is not taking down these sellers to make a buck. They take them down because they want to make the cards less accessable.

    Best move is just to close shop and move on Legal president against flashcards is well esteblished.

    Think he is mostly confused aboit civil vs criminal law, denying everything in civil law is not gonna help you.

  8. Nemes says:

    I don’t even know what to say. That response isn’t *insane*, but good heavens is it completely oblivious to how the legal system works. It’s only slightly more thought out than the old warez sites that tried to tell cops that they couldn’t view the site.

  9. Yearls says:

    What about all those sellers on Etsy and the like, that sell SD cards stacked with all manner of retro games, including some Switch games?

    Why target someone who is unlocking consoles and not those people?

    Nintendo are really going scorched earth with this cracking down thing.

    Best of luck to this guy.
