Did Sony just update their terms of service in response to the Vita hack release?
I got contacted about this thread on reddit that talks about a recent change of the terms of service of Sony’s PSN. Reddit user jixosin says:
Just opened PlayStation Store and notified of PSN terms of service change as of the end of July, there is a bit of new stuff regarding modification of system software and piracy, anything to be worried about?
He goes on and quotes the changes that are visible to him in the Terms of Service update:
I’ve read through most of the relevant stuff, while this isn’t anything new it stands out and is more specific; this results in a PSN ban as well as more consequences like console ban too:
disrupt, misuse, modify, adapt, translate, hack, crack, reverse engineer, decompile, or disassemble any Product or part of any Product (or any equipment, system or infrastructure used in connection with the PSN) for any reason unless expressly permitted by applicable law; or (iii) create any derivative works, attempt to create the source code from the object code, or download a Product or any part of any Product for any purpose not authorised by us; or (iv) scrape, copy, reproduce, communicate to the public or transmit, use for public performance or exploit any Product or part of any Product including any information accessed via or in connection with the PSN; or (v) use or make available unauthorised hardware or software to access or interact with the PSN or its Products (including any cheat code or devices that circumvent security features or limitations); or (vi) bypass or attempt to bypass any user authentication system or security features unless expressly permitted by law;
Such an update would certainly echo my fears that HENkaku could lead to some bans, but this time I’ll try to be the voice of reason and say there is no reason to be worried about this update, at least not more than when I said that bans might come. Here’s why:
First, as others have pointed out, this update is specific to the EU PSN. The US counterpart, apparently, hasn’t been updated since April. If that update had been in reaction to the HENkaku launch, I would expect it to have happened on all PSN terms of service, not only the EU one. It seems this one update has more to do with a recent legal change of the name “Sony Network Entertainment Europe Limited” to “Sony Interactive Entertainment Network Europe Limited”, and less with tinkerers.

By comparison, here is what the US Terms and conditions for the PSN say about hacks:
Except as stated in this Agreement, all content and software provided through PSN First Party Services are licensed non-exclusively and revocably to you, your children and children for whom you are a legal guardian (collectively for purposes of this section, “You” or “Your”), solely for Your personal, private, non-transferable, non-commercial, limited use on a limited number of Authorized Devices in the country in which your account is registered. All intellectual property rights subsisting in PSN First Party Services, including all software, data, and content subsisting in or used in connection with PSN First Party Services, the Online ID and access to content and hardware used in connection with PSN First Party Services (collectively defined as “Property”), belong to SIENA and its licensors. This license and all use or access to Property is expressly conditioned on your compliance with this Agreement’s terms, other applicable agreements, if any, and all applicable copyright and intellectual property rights laws.

You may not sell, rent, lease, loan, sublicense, modify, adapt, arrange, translate, reverse engineer, decompile, or disassemble any portion of the Property. Except as stated in this Agreement or as SIENA expressly permits by SIENA, you may not reproduce or transfer any portion of the Property. You may not bypass, disable, or circumvent any encryption, security, digital rights management or authentication mechanism in connection with PSN First Party Services, Authorized Devices, or any of the content or services offered through PSN First Party Services.
Secondly, as jixosin and others also mention on reddit, this isn’t totally new. These statements were already in the PSN ToS in one shape or another: Sony reserves the right to ban people who hack their console, in particular those who start messing up with the Network (which includes in particular people who cheat online or think it might be a good idea to start tinkering with trophies).
Bottom line is, there doesn’t seem to be any (additional) reason to freak out here.
Nevertheless, I’d still recommend people to not use their own PSN account on a PS Vita that has HENkaku running. But maybe that’s just me being paranoid.
That is why I ran Henkaku once, put it in flight mode and called it good. Can’t really ban me if I’m not connected.

I just use the savedata method to transfer my vpks in a zip file, use filer to extract them somewhere and then moleculeShell, to install them.
You could block the MAC address of your Vita from accessing the Internet in your router. That way it will only be able to make LAN connections so FTP will still work.
Can’t you just log out of PSN?
You could set up a WiFi network on your computer using a regular WiFi adapter/card. The adapter can’t act as both a client and host at the same time, so you wouldn’t have to worry about the Vita connecting to the Internet.
My router doesn’t correctly block Internet access for clients and I’m guessing that other router models don’t, either. So I’d be careful with MAC address blocking.
My laptop has duel WLAN cards (BIOS mod using WAN slot), I can broadcast and still be a client at the same time.
What I would do is get a older router than can be put into bridge mode to attach to your current router, and just limit the connections on that secondary router. Say block all Sony/PSN/SEN traffic.
It’s still saved in your activity log though that you used Henkaku (or the molecule app to be precise). So unless you’ve deleted your activity before reconnecting then Sony “could” still know what you did…XD

What is the difference between keeping your Vita always in flight mode and being banned ?
In this case he can’t use internet with his Vita, in the second one in can’t use his SEN account anymore.
That wording is such an entire clusterfuck that it’d be pretty much unenforceable as-is. They can’t sue you based on that wording, and they could ban you whether or not they added that. Basically, nothing’s changed.
The Devs should worry about making a jailbreak for Ps4 that yes would be something extraordinary

Release piracy man, but put on a time limitation like downloaded (pirated) games would only work for 1 hour max then you have to buy the game or delete it permanently

I use HENkaku to run a whitelist hack. I can’t use it with a different PSN account. All I can do is either log off, or change the titles of my hax.
Now Team Molecule should find method of masking of the changes that HENkaku did on the system… hide processes etc.
I never read Sony ToS/EULAs because it always boils down to “we can ban your account and all consoles whenever we feel like for any/no reason whatsoever”. After having my account banned when the first ps3 jailbreak came out im not going to risk my ps4 main account so ive already deleted henkaku and all homebrew from my vita. I havr a 2nd vita with vhbl whivh i never connet to the network and thats sicky enough for me.
might have to buy a 3rd vita and start a new account then ill do the henkaku thing like i did with the ps3 jailbreak.
You don’t need an account for Henkaku so your second Vita would be just fine and HenKaku will be far better than VHBL soon enough.
Note to self: start buying exclusively physical copies of games.

The rule I follow is if I want to explore the unofficial software side of a product then get two or more devices and keep one pure.

I always just run my Vita consoles in whitelist mode. The only site they can connect to is the henkaku site. Everything else is blocked. That way, I can still load the exploit, FTP locally, and not worry about accidental updates or bans.
Question, is it really necessary to go that far? As long as you’re logged off from PSN how would they find out?
Just why? in France and Europe end users have full right to use, modify or resell any hardware and software they acquire (intellectual property is loss at the time they bought it, no authorization to sell illegitimate copy, but right to resell digital content and modify everything as an abusive clause in considered as null with our laws) … and they did this only on EU playstore …
I choose to live the thug life and keep playing my pokemon. If sony wants to ban my console, so be it. Although, I think that the henkaku hack isn’t hurting their sales on either psp or vita games. All we can do atm is enjoying emulators and homebrews.
Sony should embrace an open platform of the Vita. It could revitalize it

clearly, simply migrate the bootloader to something like uboot or and UEFI bootloading system to led the user choose for a secondary os stored an memory card, their system ‘ll be safe and user can develop or enjoy opensource program and game without piracy …

Just release piracy on PSP guys… This is the only way to revive vita. Piracy on vita thru PSP won’t affect sales on the developers as it is already widespread on PSP itself. The only thing it will do is bring more userbase to vita leading to more purchases of the handheld and more purchases on vita games. Forget about PSP games already. Every game dev already knows there’s no furtune on PSP games now.
Come on…. Sony Just need a time to released a New firmware, blocking everthing again. My 2 cenas is Sony Will release a maior security path in a month maybe before. The device don’t get same status than ps3 was. Lost firmware in a custom firmware. This really was a slap in the Sony face. After all psvita currently don’t matters anymore yo Sony.
It’s funny too, when I read the new ToS last night, I noticed they dated it July, so I’m guessing they’ll target anyone who used HENkaku(and was detected) even before accepting the new ToS.

I wont sign these new TOS, they give the end user no rights whatsoever, Im fed up to the back teeth, these software giants telling me us to do, so My Old PS3 is nearing its end anyway, and I havent the funds for the outrageous price of a updated ps4 when I dont need one. DRM and hostile TOS are gradually ruining any enjoyment once had when Playstation 1-2 came out. This goes for origin, EA games, Steam, they all think they own us , well they dont own me or my console its mine to do what I want with it.
Stupid Question, i have an only wifi Vita, if i choose the option to forget all my networks saved, would i be at risk of ban?
