It’s legal to hack your PSP…unless it’s a Phat

If you’ve been following hacking news of other devices, you probably know that recent updates in the US law finally confirmed that jailbreaking an iPhone is legal in this country. Out of curiosity, I read the original announcement from the US copyright office. Of course, I assumed it doesn’t mention the iPhone specifially, so maybe this change in the DMCA would have a positive impact on the PSP as well ?
It turns out that the hacking of the PSP remains in a grey area, as the article says:
The purpose of the proceeding is to determine whether current technologies that control access to copyrighted works are diminishing the ability of individuals to use works in lawful, noninfringing ways.[…]
Computer programs that enable wireless telephone handsets to execute software applications, where circumvention is accomplished for the sole purpose of enabling interoperability of such applications, when they have been lawfully obtained, with computer programs on the telephone handset.
So, you are authorized to jailbreak your iPhone, if your goal is to run software that you legally obtained AND that cannot run on the iPhone because of DRMs. In other words, it is alright to jailbreak a phone in order to run homebrews.
What I find annoying is that this precision in the law specifically mentions “wireless telephone handsets”…which the PSP isn’t…oh, but wait, Skype is officially provided by Sony on the PSP 2000, 3000, and on the PSP Go, so technically, these PSP are wireless telephone handsets…
Hence my cool conclusion of the day: in the US, hacking your PSP (for example using Half Byte Loader) to run Wagic is perfectly legal, unless it’s a psp 1000 🙂
By the way, it is wrong to say that it means that hacking a psp1000 is illegal in the US. It just means the psp1000 remains in a grey area because it is not a handled phone. Companies like Apple and Sony will always try to make you believe that hacking your device is illegal. The truth is, it’s not. Of course, hacking these machines will (obviously) void your warranty, and what you do with an unlocked device can be illegal, but that’s a different story.
Additionally, the update of the DMCA clears another area, for reverse engineering. It is now officially legal to look for vulnerabilities in video games, as long as your goal is to improve the security of the game and/or fix bugs. To quote the statement:
Video games accessible on personal computers and protected by technological protection measures that control access to lawfully obtained works, when circumvention is accomplished solely for the purpose of good faith testing for, investigating, or correcting security flaws or vulnerabilities, if:
(i) The information derived from the security testing is used primarily to promote the security of the owner or operator of a computer, computer system, or computer network; and
(ii) The information derived from the security testing is used or maintained in a manner that does not facilitate copyright infringement or a violation of applicable law.
I believe such a law was already clearly specified in many European countries, in order to protect Free Software and the right to fix bugs on systems you own, as well as IT companies that specialize in security.
In case you didn’t figure it out, I’m not a lawyer, so this article has absolutely no legal meaning 🙂

I really hope we find a kernal exploit soon – the half byte loader is really awesome, and so far it does everything I want it to do. I really miss running homebrew straight from the XMB, but ill live with it. Keep up the good work HBL has went a long way, you guys have done an AWESOME job!!!
Lol, good point wololo. But as far as I know your alowed too hack/edit Out of date or expired programs/systems witch sony said themselfs that the fat is no longer supported.
Nice write up there Wololo. Glad someone tries to figure out the legality of the hacking scene. I mean even it were illegal to modify your iphone/psp how would such law be enforced on the millions of people who use theses modifications. I don’t have much worry about it at all. (seeing I only own a 3000 model psp running HBL, homebrew only) And as cell phones go, I use Verizon and modify my files using p2ktools and bitpim.

it isnt hacking the psp thats illegal, but what people do after they hack it, ie. download games of the internet and hack psn

The question of legality will always remain in this digital world. In fact, arguments have went so far such as an organization called “questioncopyright.org” claiming in a youtube video titled “Copying is Not Theft” that copying isn’t theft. According to them, piracy ain’t theft! I’m sure most of you have seen that video.
Also, I do believe that DRMs and copy-protection technoilogy have done nothing but trouble *both* the customers who bought it and *pirates*, but troubled the customers more! Surely people who bought games like Assassin’s Creed 2 for PC understand this. I’m just rambling! 🙂
That aside, it is nice to clear up the legal issues of hacking/jailbreaking devices! VIVA LA HBL!

We have a right to enjoy homebrew on any device that we have.
Now I have PSP. This is legal of course.
So that we have a right to enjoy homebrew(=legal) on PSP(=legal) but we have to unlock it(=means “Legal”) before doing that.
This is what I think now.
Sony always insist on “Reverse engineering of the Software is not Authorized.” in UMD BOX. “Authorized” does not mean “Legal”. Why do I have been prohibited to reverse anything about PSP?

I was about to type the same thing. It seems that buying a product means renting the item for life. Companies doesn’t allow you to tamper with the product. But it is still “yours”.

i kno if we baught the item we should be able to do whatever we want with it… Because its ours not sonys anymore… If i wanted to throw my psp on the street and break it sony wuldnt care cuz i already baught it… But if i wanted to make it better and fix up my psp then they dnt like that. .. i just realized maybe sony does kno that… And they dnt care if u have cfw its just that they can get sued if other gaming systems find out that they are allowing there games to be played on the psp, such as nintendo…

yea we bought this equipment so whos to say we cant modify it? a psp is like a car once you have it you can either let mechanics keep it stable or you can improve it yourself.
also if we were to build an exact duplicate of a psp would it still be technically illegal to run homebrews and hacked stuff on it? if so thats really f**ked up

As a former business law advisor, and current business writer, I think that I could shed some light on this.
A wireless telephone would be a device which has a primary use of connecting to phone lines or towers so that someone can have a phone conversation. Essentially, if the primary function is to speak on the phone, it is a wireless phone. If talking on the phone is secondary (such as a PSP with Skype, or a computer with Skype) this law does not apply.
From the train of thought that a device with Skype would be considered as a wireless phone, that would mean that I cannot legally modify my home computer. Neither my PSP, my PS3, nor my computer are wireless phones, so there is no decision yet where legality is concerned.
@L. Vincent Poupard : thanks a lot for the clarification. I don’t really understand why the law applies only to phones (from a logical point of view), but I kind of feared that it was too good to be true 🙂

Hum, there was a point before Skype was offered officially. So… as that’s the case, then I’m assuming it’s possible to bring them into this field and it becomes legal. Or at least that’s the suggestion.
If that’s the case, then it follows for fats, with the homebrew furkip that also allows voip service, that it would be equally as legal for the phat psp’s.

I read it’s legal. I have a jailbroken iPod Touch and I read under Rock Your Phone that unlocking any cell phone or game device is legal. The Rock App took me to the New York Times site which is where I found this.
with a go cam for psp mounted on the phat, I suppose you can run skype, cant you?
