If you don't already have a DS, then go for it. There are plenty of good DS games out there, like Devil Survivor. If you're just getting it for 3ds games then you'll be disappointed though. I highly recommend getting a DSTwo to go with it, so you can play DS homebrew, gba games, and a few DS games that were only released in Japan but have 100% translation patches. Tales of Innocence is a prime example.

If you do get a DSTwo though, make sure you don't get stuck with a fake.

Do you have a DS? That's a factor; the DS library is quite impressive.

Look through the 3DS library and ask yourself if any of the games there look good to you. I personally enjoy my 3DS quite a bit, but if you're the world's biggest FPS fan, then even $80 is a waste of money.

A bit late but I recently bought a used 3DS (limited Zelda Ocarina edition) with the game for $115. It was great for the first few days but I just don't find the urge to play it much any more.

Check out fire emblem awakening, the upcoming pokemon x/y and animal crossing: new leaf. As far as I know, these games draw in the most buyers for the 3DS thus far, although you have fun little titles like Super mario 3D land and Mario Kart 7. Personally, I would think the upcoming ace attorney 5 is a great reason to buy a DS as well as the hope for a translation of Ace attorney vs professor layton.

If you have no interest in any of that, then I recommend sticking with a DS instead.

A new one or used one?
If it's a used one:
check the screens if not scratched to much especially the touch
check the battery (will require to open the 3ds) if its bloated then it's dead -> requires you to buy a new one
check the hinges, they should lock the first time at about 160° and the second time at about 190°(screen opened) somewhere around, if not they're damaged.
And also they can still lock but the resistance from the hinges is much to less and the screen could still fold in an unwanted direction. (like mine )
If it's a new one: BUY IT

Super Mario 3d Land, New Super Mario bros 2, Donkey Kong Country Returns, Resident Evil Revelations, Zelda Ocarina of Time, Tales of the Abyss, Castlevania Mirror of Fate, Monster Hunter Ultimate, Fire Emblem, Shin Megami Tensei IV and an entire library of DS games to go with it. Get a DSTWO and start downloading. Radiant Historia is my FAV DS rpg next to the rerelease of Chrono Trigger.

So if you are into Mario, monster slaying and RPGs than I would say its a safe bet. Plus that 3DS is only 80 bucks! Take it man, you will not regret it!
