First, I'm on 9.2 firmware, original 3DS but this should also work for 3DSXL but I was stupid and upgraded my 3DSXL to 9.7 last week.
Also you need Ninjhax so you will need the Cubic Ninja game.
ok, I'm not sure what I did first as I did lots of things recently but this works for me.
I'm not sure if you need to do this but I did, its still good to have this backup anyway.
Download the gateway firmware. (you DONT need a gateway card, just the firmware files etc)
download the rxtools.
make the firmware file. It should be in the rxtools package somewhere.
Make the slot0x25KeyX.bin file. Google is your friend here, I think its illegal to post so I wont but it wasn't hard to find the details to make it.
Copy the gateway LAUNCHER.DAT file to the root of the SD card.
On the 3DS load up the internet browser and goto go.gateway-3ds.com
That will start the gateway menu.
scroll across to FORMAT EMUNAND. (This will wipe the SD card so make sure you already have it backed up)
When that finished press DOWN and B and it will turn off.
Now, go back to the PC and copy over the backup of your SD card.
Make sure you have the ninjhax files.
copy any legal CIA files to the root of the SD card.
copy FBI into ninjhax (Which is in the folder 3DS/FBI or something like that)
back to the 3DS.
Load up cublic ninja and ninjhax
Load up FBI
Install CIA to SD card (thats the default settings so just choose the CIA file.
WAIT!..... Yea, it takes ages. About 30 mins for a 500mb file.
Done, you now have a 3DS game installed.
BUT we aren't finished here.
If your like me and have a heap of original 3DS games and want to copy your save across from the cart to the digital version you'll need to do this.

Do that, get that file.
copy code.bin to the root of the SD card.
Boot 3DS.
Boot back into the gateway menu,
This time choose BACKUP GAME SAVEDATA
Exit, reboot 3DS
goto that website it posted and it will spoof the firmware.
Now, if you dont have it already goto the store and get the savegame transfer.
Now insert your original cart. MAKE SURE you have the digital game installed also.
Load up the transfer tool.
Copy your savegame from the original cart to the digital version.
That will wipe your cart so its now empty.
If you want to use your cart on another 3DS again you will need to go back to the gateway menu and RESTORE GAME SAVEDATA.
There you go. Now you can enjoy your games directly from SD card with save data from the cart.
I tested it on Mario Kart 7 and it works fine. Both the original cart and digital version have the same save data and work fine.

(I'll come back when I have things free and fix some mistakes and names but you'll get the idea when your doing it. The gateway menu probably isn't game save gamedata but as my 3DS is busy I cant check it right now.
