Our rule is that we take the word of the author. If the author tells us they have the rights to use the graphics, we take their word for it. For this specific entry, we asked twice, and the author told us twice that he made those drawings himself. Even when it is unlikely, we trust the author's word over our own verifications. It avoids us having to do long checks on the assets of a game, and put the responsibility on the author of the homebrew.
Edit: If that makes you feel better: the above is just a matter of legal responsibility. But from a judge's point of view, if a game was accepted that uses stolen/unoriginal graphics, this will have a negative impact on its score.
