i am not a judge, but lets be realistic. would nintendo ever give anyone permission to use anything related to mario in a homebrew game for a hacked psp? lolno. so, should that keep people from making quality homebrew games? should that keep this guy from entering the competition? i guess that will be up to the judges to decide
btw, there have been a couple of mario homebrew games (as well as many others, like zelda, pokemon, etc.) that have been released in the past and i didnt see anyone crying foul over those:

Pretty much Hacked PSPs in general are illegal, but that doesn't stop people from obtaining them, or hacking it themselves.
And This is a competition where there is money at stake which makes submitting your homebrew(Which is mario which belongs to nintendo) pretty risky. I love Mario homebrews, but lets see what the judges say. I wish the bar could be dropped a bit to allow for their favorite games to be made.

They already said they were entering and there isn't any fussing going on, and they didn't ask the COD developers if they could make it either. What about Revamped, which is unmistakeably Halo for PSP. It just contains a few original gimmicks and name changes. It seems to be still allowed.

do whatever you want with it. The problem is the isoloaders etc. that pring pirated games into this
which makes that part of it illegal. If your mario sprites are ripped straight from the game, its considered
illegal but if you made them yourself, you should be fine, as long as the title isnt mario.

Plain and simple, you can't use the Mario trademark, BUT, let's say you don't call it Mario. Let's say you call it something else. And you edit things such that they don't recognize certain trademarks so unmistably. Do you follow me? Change the name, and don't use Mario / Luigi / other Nintendo characters names, as plain and simple BECAUSE this is a competition and there is money involved this could cause a problem. I understand a lot of the arguments made in this thread, but "Mario Kart PSP" plain and simple we KNOW Nintendo would not give permission.
To the author, PM me (npt) or Wololo and we can discuss ways to make this enterable. This is nothing against you, I like the game, but as for allowing entered under this name and with Mario and koopa stuff in it... anyway, pm one of us.
Until then this is locked.
