There probably waiting for TN HEN to come out then a maybe a cfw then they can block it??

Assuming this is not a fake, it is still a bit weird. The release of 6.35 was just 5 days ago. There is no chance a firmware update can be written, tested and pressed on UMDs in that time. I would think UMD production will have a lead time of several weeks. And I am not even tallking about the time it takes to deliver it to retailers where it probably leaked from (since the game is not officially released yet).
I really don't know why they would need another special update for this game when they could obviously have included those fixes in the last regular firmware update. If it was 6.3(2-4) I could understand it, but with 6.36 they must have anticipated the 6.35 update and still seen a need for including this update on the UMD.
Edit: It would also be possible that Sony deliberately didn't push out a firmware with the features that make this game unplayable as ISO for now, to delay pirating of the game to a couple of day after the release.
i do believe things like this have happened before.
i think the last time this happened, the "newer" version was in fact older and lacked some "security updates" while instead having some changes required for the game.
i think it was with 5.05 in which the gripshift exploit wasn't fixed, even though it was fixed 5.03
